Can I Reimburse Employee For Individual Health Insurance Policy Premium?

I have a side business where I employ 1 employee. I don't work at the business full time. Because it's only 1 employee I couldn't get group health insurance so he purchased an individual health insurance policy. My question is: can I reimburse him the cost of the policy and write it off as an expense? Do I need HRA for that or anything else? The business is in NJ. Thank you very much!


Answer: Yes you can use it as a tax write off.
 
 

A Question About NJ Health Insurance Coverage Rules For Pre-existing Coverage:?

NJ law states that a new health insurer has to cover pre-existing conditions if that individual had 18 months of continuous coverage prior to the new coverage. If someone had over 18 months in coverage, then one month of coverage with another insurer, then wants to switch to a different insurer, will the pre-existing coverage claus that requires an insurer to cover pre-existing conditions be in effect with the third insurer? Does the 18 month rule only apply to the health insurer that immediately


Answer: It doesn't matter how many insurers you had, as long as the coverage was continueous. You could have 18, and it would still apply. It's the "continuous" that's the important part, not the number of carriers.

NJ Health Insurance Question, Regarding What 'partner' Stands For?

my longtime boyfriend and i have been discussing having a child. i don't have a job with health insurance, but he does. on his policy, there is an option for individual +spouse or partner and child. am i correct in assuming that by partner, they mean a same-sex partner as opposed to a long-term companion?

i am aware that child would be covered regardless, but am i not eligible for his plan unless we're actually married?

(not sure exactly what company he has)


Answer: The definition of "partner" depends on the policy at your boyfriend's job. Many businesses in the NY/NJ metro area include domestic partners (of the same sex as well as heterosexual couples) in the definition of "partner." Also, you can register as a domestic couple in NJ. You need to check with the benefits coordinator at your boyfriend's job to find out if you are covered, but you probably will be. You will need to prove that you are actually a couple, and the best way to do this is register as a domestic couple in the state of NJ.

Also, even if you are not covered under his health insurance, most states usually provide Medicaid or some similar program

What does the law say in New Jersey on this subject?
